Effective as of 28th March 2018
- This Agreement. Instructions, prizes and information on how to enter form part of these Terms and Conditions.
- Promoter. The promoter is KAYAK Software Corporation, 7 Market Street, Stamford, CT 06902 USA (“KAYAK”)
- Entry. Entries are open to legal residents of Australia. Entrants must be at least 18 years of age. Employees (and their immediate families) of KAYAK and third parties associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step- grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. Only one entry per person is permitted.
- No purchase necessary. Participation is free of charge. No purchase or payment is necessary to participate in this competition.
- Time Frame. The promotional period begins at 12:00 am AEST on Thursday, 29th March 2018 and concludes at 11:59 pm AEST on 2nd April 2018 (“Promotional Period”).
- Eligibility. To be eligible to enter, individuals must, during the Promotion Period:
- Search for the hidden Tahitian pearls within the KAYAK Travel Hacker Blog in Australia (www.kayak.com.au/news)
- On the form, complete this sentence in no more than 30 words. “KAYAK should send me to explore Tahiti because…”
- Fill out the form with your personal details on www.kayak.com.au/news/takemetotahiti
- License to content. By participating in this campaign, entrant gives KAYAK, its respective parent and affiliated companies and its representatives, the right and irrevocable license to use, reproduce, disseminate, publish, distribute, represent publicly, edit and modify the content submitted in this campaign around the world and in perpetuity, with no remuneration whatsoever and, where appropriate, for all purposes related to KAYAK’s activities, including but not limited to dissemination through various media.
- Disqualification. KAYAK reserves the right to disqualify any participant that it believes, in its sole discretion, to be in breach of these terms and conditions or to act in an unsportsmanlike or disruptive manner, or to tamper with the competition. This includes the submissions that are obscene, hate-mongering, libelous, defamatory, discriminatory or otherwise offensive. Disqualification shall be final and will not be explained.
- Winners. KAYAK is giving away 2 return flight tickets from Sydney, Melbourne or Brisbane in Australia to Papeetee in Tahiti to a lucky winner. Only one winner will be selected and the winning entry will be chosen from all entries received. This is a game of skill. The winner will be chosen on Friday, 6th April 2018 by a internal KAYAK jury based on a combination of the following criteria: uniqueness, originality, creativity and conformity with the theme. The prize that the winner will receive is a round-trip economy flight ticket for two people. The prize does not include government taxes of these flight tickets amounting to approximately $180 per person. KAYAK will not be responsible for those government taxes. The trip must be taken before 28th February 2019 and blackout dates include high peak periods such as Easter, Christmas and New Year public holidays. Upon receiving the prize, instructions will be provided by KAYAK to the winner and the winner shall contact the airline directly to redeem the booking according to the winner’s choice of dates. The Prize is not transferable or exchangeable and no cash alternative is available for any prize. Prize is supplied “as is” and “as available” with no express guarantee as to their suitability. Winner is responsible, as required, at their own expense, for any relevant & suitable travel insurance, and for complying with any necessary documentation, including but not limited to, valid passports, visas, and health requirements.
- Notification. The winner will be notified by 6th April 2018 by KAYAK, and the participant agrees to such publication of his / her name by entering the contest, or by email and phone. The winner must confirm acceptance of the prize within fourteen (14) natural days of notification and complete any necessary documentation, otherwise, KAYAK reserves the right to award the prize to an alternative winner from the remaining eligible entries at its sole discretion and the exercise of this right shall be final and will not be explained. The Winner is solely responsible for all expenses and fees associated with acceptance of the prize, including without limitation, any federal, state, or local taxes.
- Privacy. By participating, entrant is permitting KAYAK and its appointed agents to use his /her personal details for the purposes of administering this contest. KAYAK’s privacy policy will apply, please visit http://www.kayak.com.au/privacy for more details.
- Disclaimer. To the fullest extent permissible by law, KAYAK disclaims all responsibility for and shall not be liable for any failure to notify, damage suffered, loss, costs, unexpected events, accidents and/or injuries which may occur to any participant in the course of running this contest, however caused. Participation in this contest is at the participant’s’ own risk and cost.
- Changes to contest. KAYAK reserves the right to make changes to the competition arrangements and details at any time, including the right to declare this competition null and void or cancel it. All issues, construction, interpretation, and enforceability of these rules will be governed by the laws of England and Wales.
- Release of Liability. This contest is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram or Twitter. By participating in this contest, you completely release Facebook, Instagram or Twitter of all liability in relation to any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from your participation.
- Intellectual property. The entrant guarantees that he/she owns all the intellectual property rights of the content provided. Thus, the participant shall indemnify, defend and hold KAYAK harmless from and against any and all costs, claims, demands, liabilities, expenses, losses or damages, including attorney’s fees that arise or result from the infringement of any third party right.
- Acceptance of terms and conditions. Entry into this competition constitutes your acceptance of these terms and conditions which shall constitute the entire agreement between you and KAYAK as regards this competition. There shall be no legal recourse.
